Heard learned counsel for petitioners and learned A.G.A. for State of Uttar Pradesh.
Counsel for the petitioners submits that since it is a matrimonial dispute, an opportunity be granted to the parties for reconciliation of their dispute by way of mediation. Petitioners are also willing to settle the matter through mediation.There is a chance of compromise.
The matter is referred to Allahabad High Court Mediation & Conciliation Centre. The petitioners are directed to deposit a sum of Rs.15,000/- before the Mediation & Conciliation Centre of this Court by way of demand draft / pay order payable at Allahabad, within a period of three weeks from today. 80% of the amount so deposited shall be paid to respondent-3 Umesh Kumar Pandey. After deposit of the aforesaid money, the Mediation and Conciliation Centre shall issue notice to the parties, fixing a date for mediation. The Mediation & Conciliation Centre will submit its report in the matter within three months.
List this case before appropriate Bench along with the report of Mediation Centre. The case is released from the order of assignment.
Till the next date of listing, no coercive action shall be taken against the petitioners in pursuance of F.I.R. dated 11.12.2018, registered as Case Crime No. 1081 of 2018, under Sections 498-A, 323, 506 I.P.C. and 3/4 Dowry Prohibition Act, Police Station- Ghatampur, District- Kanpur Nagar.
If the amount, as directed above, is not deposited by the petitioners within the aforesaid period, the stay order shall automatically come to an end and the office shall immediately list this case for further orders before the Court.
