1. Heard Sri Kunwar Mayan Singh, learned counsel for the petitioners, learned Standing Counsel for respondents No.1 and 2 and Sri Azad Rai, learned counsel for respondent No.3. Notice need not be issued to respondents No.4 and 5 at this stage.
2. The only relief sought in the writ petition is that Suit No.407 of 2012, (Ram Prakash Singh vs. Smt. Radha Devi and others) under Section 176 of U.P.Zamindari Abolition and Land Reforms Act, 1950 before Sub Divisional Magistrate, Tehsil and District Fatehpur, respondent no.2, be directed to be decided expeditiously.
3. Learned Standing Counsel fairly states that in case the aforesaid case is still pending and has not been disposed of, the same will be considered and decided expeditiously.
4. As no useful purpose would be served in keeping the matter pending or calling for counter affidavit, as such, respondent No.2 is directed to decide the aforesaid case, expeditiously, in accordance with law, if there is no legal impediment in deciding the same, preferably within a period of one year from the date of receipt of a copy of this order downloaded from the website of the High Court, after hearing all the parties concerned.
5. Writ petition stands disposed of.
