JUDGMENT / ORDER

Petition under Sections 437 & 439 of CR.P.C., praying that in the circumstances stated in the petition and the grounds filed herein, the High Court may be pleased to enlarge the Petitioner on bail in Crime No. 55 of 2014 of KPHB Police Station, Cyberabad.
The petition coming on for hearing, upon perusing the petition and the grounds filed herein, and upon hearing the arguments of Smt G. Seeta Devi, Advocate for the Petitioner and of the Public Prosecutor on behalf of respondent-State, the Court made the following ORDER:-
The petitioner is A-3. He seeks for grant of bail. He allegedly committed offences under Sections 376-D, 379, 420 and 328 read with Section 120-B IPC.
The petitioner along with other accused allegedly gang raped the victim, who is a small time actress at Mumbai. It is the case of the prosecution that the present petitioner is the supplier of the film personalities for performing shows at Hyderabad. The petitioner is a resident of Hyderabad. Some of the accused have already been enlarged on bail. As many as 23 witnesses have already been examined by the investigating agency.
In view of the fact that the investigation is more or less completed and also in view of the fact that many of the other accused have already been enlarged on bail, I consider it appropriate to enlarge the petitioner on bail. However, where the petitioner is a resident of Mumbai, I consider it appropriate to impose a condition that the petitioner shall stay at Hyderabad and appear before the police regularly.

Accordingly, this Criminal Petition is allowed. The petitioner is enlarged on bail on a personal bond of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties in a likesum to the satisfaction of the learned XIX Metropolitan Magistrate, Cyberabad, Miyapur. After his release, the petitioner shall appear before the SHO, KPHB Police Station on every day between 9.00 AM and 7.00 PM till the charge sheet is filed.”
