Heard learned counsel for the petitioner, learned standing counsel for respondent no. 1, 2 and 3 and Sri Raghvendra Pratap Singh, learned counsel for the respondent no. 4.
Learned counsel for the petitioner submitted that the petitioner had appeared in Assistant Teachers Recruitment Examination, 2018. He further submitted that he does not want to press the rechecking of question nos. 19 and 77 and only pressing the question no. 37 and in case one mark is awarded in question no. 37, he would come in select list after obtaining 60 marks. He next submitted that the present controversy was already subject matter in Writ-A No. 5365 of 2019-Radha Devi and others Vs. State of U.P. and others, which was allowed by this Court vide order dated 17.5.2019. Against the said order, Special Appeal Defective No. 756 of 2019 (State of U.P. and others Vs. Radha Devi and others), was filed which was also dismissed by this Court vide order dated 20.8.2019.
Sri Raghvendra Pratap Singh, learned counsel for the respondent no. 4 has not disputed the aforesaid fact.
Under such facts and circumstances of the case, this writ petition is allowed in terms of the order dated 17.5.2019 passed in Writ-C No. 5365 of 2019 and order dated 20.8.2019 passed in Special Appeal Defective No. 756 of 2019.
