This criminal revision has been moved on behalf of the revisionist seeking the quashing of judgement and order dated 12.3.2019 passed by learned Family Judge/F.T.C. No. 1, Bareilly in Criminal Case No. 765 of 2016, Smt. Jyoti vs. Rohit Kumar, under Section 125 Cr.P.C., whereby maintenance of Rs. 5000/- per month to the opposite party no.2 from the date of order has been fixed and also directed to pay Rs. 20,000/- to the opposite party no. 2 as expense of case.
Heard learned counsel for the revisionist and learned A.G.A. Perused the record.
Learned counsel for the revisionist has not been able to point out any illegality, impropriety or incorrectness on the basis of which the impugned order may be castigated which reflects judicial application of mind. The facts and circumstances of the case have been taken into consideration by the court below. By the impugned order Rs.5,000/- per month for the wife has been fixed as a matter of maintenance which in the present days of price hike, cannot be said to be either excessive or disproportionate. There is no abuse of court's process perceptible in the same. There is no good ground to interfere in the impugned order.
The revision lacks merit and stands dismissed.
