Heard learned counsel for the parties.
The present review application has been filed seeking review of the order dated 08.09.2020 mainly on the ground that prior to the last date of submission of application, the applicant did not possess the requisite qualification prescribed under the Rules.
It is argued that in the result of the examination of 4th Semester declared on 11.12.2018 the applicant was declared as failed, thus he did not have the requisite qualification on the said date.
The counsel for the respondents, on the other hand, argues that the applicant was wrongly issued mark-sheet declaring him as failed whereas subsequently a fresh mark-sheet was issued to the petitioner showing him as passed.
Thus, on the basis of a wrong mark-sheet issued prior to the last date, the respondent could not be non-suited. In any view of the matter, no case for review is made out under well carved out provisions for exercise of review under Order 47 Rule 1 of Civil Procedure Code, 1908.
The review application lacks merit and is, accordingly, dismissed.
