This writ petition has been filed, seeking to direct the respondents to restore the service connection to the name of the petitioner within a time frame as may be fixed by this Court.
2.The learned counsel for the petitioner would submit that the subject mentioned property belongs to the petitioner and electricity service connection also stood in her name. While so, the fourth respondent filed a suit in O.S.No.41 of 2008 before the District Munsif Court, Melur in respect of the above said property, which is said to be pending. All of a sudden the respondents transferred the electricity connection in the name of the fourth respondent. Aggrieved over the same the petitioner on 22.01.2010 sent a representation to the first and second respondents to restore the connection in her name. Since no action has been taken by the respondents, the petitioner is before this Court.
3.The learned counsel for the respondents would submit that nothing survives for adjudication in this matter.
4.In view of the above submissions on either side, to give quietus, this writ petition is disposed of with an observation that any transfer in respect of the electricity connection effected subsequent to the filing of the writ petition / suit is subject to the result of the suit. However, it is made clear that this order would not stand in the way of the petitioner to raise all her contentions on merits and in accordance with law before the competent civil Court. No cost. Consequently, connected Miscellaneous Petition is closed.
