JUDGMENT / ORDER

Petitioner submitted Ext.P9 application before the Convener of Local Level Monitoring Committee seeking sanction to construct a residential building in paddy land. According to the petitioner, the said land has already been converted to dry land, though it is stated as paddy land in the Draft Data Bank. As per Rule 5 of the Kerala Conservation of Paddy Land and Wet Land Rules, the power to grant such provision can be exercised by the Convener of Local Level Monitoring Committee, who after enquiry has to forward report to the District Level Authorised Committee, who is the competent authority to decide whether such permission should be granted or not. 2. Having regard to the said factual situation, this writ petition is disposed of as under:
Local Level Monitoring Committee shall conduct necessary enquiry as provided under Rule 5 and place the matter before District Level Authorising Committee within a period of two months from the date of receipt of a copy of W.P.C.No.16092 OF 2014 2 this judgment and thereafter, third respondent shall take necessary decision in the matter.
