K.P.Yoganna, HCGP) This Criminal Petition is filed under Section 439 of Cr.P.C. praying to enlarge the petitioner on bail in O.R.No.1/2019-20, registered with R.F.O. Byndoor range on 09.05.2019 for the offences P/U/S 9, 39(3), 51 and 55 of Wild Life Protection Act.
This Criminal Petition coming on for orders this day, the Court made the following:
O R D E R Heard the learned counsel for the petitioner and the learned High Court Government Pleader for the respondent – State.
2. Learned counsel for the petitioner submits that even after the statutory period is over, the respondent - Police have not yet filed the charge sheet. Therefore the petitioner is entitled for statutory bail under Section 167 of Cr.P.C. Therefore the petition may be disposed of with liberty to the petitioner to approach the trial Court to make necessary application.
3. In view of the above the said submission, the Petition is dismissed as withdrawn with liberty to the petitioner to file necessary application before the trial Court, if need arises.
