Robin Gupta, S/O-Late Rakesh ... vs State Of U.P.,Thru. Secretary, ...

High Court Of Judicature at Allahabad|02 April, 2010

JUDGMENT / ORDER

Hon'ble Vedpal,J.
Heard learned counsel for the petitioner and learned Additional Government Advocate.
Under challenge in the instant writ petition is FIR relating to Case Crime No. 84 of 2010, under Sections 458, 392, 411, 307/34 IPC, police station Mahanagar, district Lucknow. We have gone through the FIR.
It has been argued by learned counsel for the petitioner that the impugned FIR has been registered against two persons, who were arrested by the police personnel, only and there is nothing said about any unknown person and in-spite of that the petitioner is being harassed unnecessarily by the police personnel. Since the FIR discloses commission of cognizable offence, the same cannot be quashed.
However, it is provided that the petitioner shall not be arrested in the aforesaid case crime number unless and until some cogent and reliable evidence comes forward against him, provided he cooperates with the investigation, which shall go on.
With the aforesaid observations/directions, the writ petition is disposed off finally.
