This Writ Petition has been filed for issuance of a Writ of Mandamus, directing the respondents to consider the representation, dated 14.06.2016 and survey the property in S.No.713/7A.
2.Mr.D.Muruganantham, learned Additional Government Pleader, takes notice for the respondents. By consent, the Writ Petition is taken up for final disposal.
3.The petitioner would claim that his father Ramasamy purchased 15 cents along with 10 feet pathway from his vendor one Palliah, in R.S.No.713/17A1, through sale deed, dated 03.06.1956. After his demise, it is under the enjoyment of his legal heirs.
4.The petitioner would further claim that under UDR Scheme, a Patta was issued for a lesser extent. The right of the petitioner has been decided by the Civil Court in O.S.No.137 of 2011. Thereafter, the petitioner approached the third respondent to survey his property and on 25.02.2016, he paid necessary fees. Since no action was taken, the petitioner sent a reminder on 14.06.2016. However, there is no progress and hence, the petitioner has filed the present Writ Petition for the relief stated supra.
5.Heard Mr.H.Velavadhas, learned counsel appearing for the petitioner and Mr.D.Muruganantham, learned Additional Government Pleader appearing for the respondents.
6.Considering the limited scope of the prayer sought for in the Writ Petition, without going into the merits of the case, this Court directs the second respondent to consider the representation of the petitioner, dated 14.06.2016, after providing an opportunity to the necessary parties and pass appropriate orders on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.
7.Accordingly, this Writ Petition is disposed of. No costs.
