Petition under Section 438 Cr.P.C. 2. Petitioner is the 3rd accused in Crime No.1172 of 2010 of Alappuzha North Police Station, registered for the offences punishable under Sections 465, 468, 471 and 511 of Section 420 r/w Section 34 of IPC.
3. The crime has been registered on the basis of a complaint preferred by the Manager of the Pattanakkad Branch of Alappuzha District Co-operative Bank. The allegation against the petitioner and the other accused is that they had forged Fixed Deposit receipts to the tune of ₹ 200 crores and forged seal and signature of the Manager of the Axis Bank in order to transmit the said amount through Bank. Based on the same, they had invited for investments.

4. Heard the learned senior counsel for the petitioner and the learned Public Prosecutor as well.
5. This is the 3rd application for anticipatory bail filed by the petitioner. Earlier two attempts were unsuccessful. The allegation against the petitioner are very grave and serious. This is not a case in which the anticipatory bail can be granted to the petitioner.
6. The learned senior counsel has pointed out the serious ailments to which the petitioner is put due to acute diabetics etc. Those matters, cannot come to the rescue of the petitioner for anticipatory bail.
Matters being so, I am of the view that the present application is not maintainable as there is no change of circumstance at all and therefore, this bail application is dismissed.
