JUDGMENT / ORDER

(Judgment of the Court was made by THE ACTING CHIEF JUSTICE ) This Writ Appeal arises out of the order dated 01.02.2017 passed by the learned single Judge in W.P.No.1782 of 2017, in and by which, the first respondent was directed to take up and dispose of the appeal preferred by the appellant herein as against the order of the second respondent directing the appellant to vacate the premises.
2. We heard the learned counsel for the appellant and the learned Addl.Advocate General and learned Special Government Pleader for the respondents.
3. It is submitted by the learned Additional Advocate General that the appellant has sublet the premises to others and after following due process, the Tamil Nadu Housing Board has taken possession of the premises itself from the appellant on 12.01.2017. Now the appellant sought for permission to run the shop till such time, the appeal pending before the Government is disposed of.
4. We do not find any merit or substance in the Writ Appeal to entertain the same. Admittedly, after following the due process, the Tamil Nadu Housing Board has taken the possession of the premises from the appellant and the question of permitting the appellant to continue with the shop does not arise. Accordingly, the Writ Appeal is dismissed. No costs. Consequently, connected CMP is closed.
