[1] RULE.
Shri L.B. Dabhi, learned Additional Public Prosecutor waives service of notice of Rule on behalf of respondent No.1. In the facts and circumstances of the case and with the consent of learned advocates appearing for respective parties, present application is taken up for final hearing today.
[2] Present application has been preferred by the applicants herein - original petitioners - original accused Nos.1 and 2 to serve respondent No.2 - original complainant by substituted service of affixing the notice on the premises at the address of respondent No.2 mentioned in the cause title.
[3] Having heard the learned advocates appearing for respective parties and considering the averments in the application, present application is allowed and the applicants are permitted to serve respondent No.2 herein - original complainant by substituted service of affixing the notice of Rule of the present petition on the premises at the address of respondent No.2 mentioned in the cause title. For that, Rule is made returnable on 31st January 2012. Respondent No.2 be served by R.P.A.D. also over and above the aforesaid substituted service at the cost of the applicants. Rule is made absolute accordingly.
