JUDGMENT / ORDER

The petitioner in the present petition seeks for transfer of S.T.C. No.186/2017 on the file of the Judicial Magistrate Court, Fast Track Court No.1, Erode, to any other Judicial Magistrate Court.
2. The only ground on which the petitioner seeks transfer is that she had a medical ailment, pending the impugned proceedings owing to which she is not in a position to travel from Trichy to Erode. Since the petitioner seeks for transfer of the proceedings within the same session division, it would not be M.S.RAMESH, J dpq appropriate for this Court to entertain such a transfer, since the petitioner has not approached the District Court to exhaust her remedy. Nevertheless, since the petitioner has a complaint of medical ailment owing to which she is unable to travel, it would be appropriate to take a sympathetic view on the matter and permit the petitioner to appear only on such occasion when her presence is required for the purpose of trial.
3. In the result, the personal appearance of the petitioner in connection with the proceedings in S.T.C.No.186/2017 on the file of the Judicial Magistrate Court, Fast Track Court I, Erode is dispensed with.
4. With the above observations, this criminal original petition stands disposed. Consequently, connected miscellaneous petition is also closed.
