R.Jayamala vs The District Collector

Madras High Court|23 June, 2017

JUDGMENT / ORDER

The petitioner was appointed as a Cook Assistant in the Panchayat Union Middle School, Vaividanthangal on 20.4.2017 and on the same day, she also declared that her family is not owning any land. Therefore, she was allowed to join duty as a Cook Assistant in the aforesaid school. Since on verification of the documents, the respondents came to the conclusion that the petitioner has given false information concealing the factum that her husband is the owner of one acre of land, passed the impugned order. The affidavit filed in support of the prayer to quash the impugned order shows that the petitioner's husband is the joint owner of one acre of land and since the said land is dependent upon the rain water for cultivation, there is no income earned by the petitioner's family. Therefore, when the petitioner admits that her husband is the joint owner of one acre of land, this Court is not able to find any infirmity with the impugned order. Accordingly, the writ petition fails and it is dismissed. Consequently, W.M.P.No.17211 of 2017 is also dismissed. No costs.
