Heard learned counsel for the applicant, learned AGA on behalf of the State and perused the record.
This bail application has been moved by the applicant, Rizwan seeking bail in Case Crime No.0071 of 2019, under Sections 498A, 304B I.P.C. & Section 3/4 Dowry Prohibition Act, Police Station Bhot, District Rampur, till conclusion of trial.
Learned counsel for the applicant submits that the applicant is husband and victim has consumed some poisonous substance, on that account, she died. Trial is going on and fact witnesses have become hostile. Statement of the fact witnesses are annexed with the supplementary affidavit. He next argued that applicant is languishing in jail since 15.03.2019.
Per contra, learned AGA opposed the bail prayer of the applicant and submits that it is true that the applicant has become hostile but burden lies upon the applicant-husband.
Considering the facts and circumstances of the case and submissions of the parties and looking to seriousness and gravity of offence, evidence, complicity of the accused, without expressing any opinion on the merits of the case and considering the submission advanced, I find that no good ground is made out for enlarging the applicant on bail.
The bail application is accordingly, rejected.
However, the trial court is directed to decide the trial of the case in accordance with law, as expeditiously as possible, without granting any unnecessary or long adjournments to either of the parties, preferably within a period of six months from the date of production of a certified copy of this order, if there is no other legal impediment.
