Heard learned counsel for the petitioner and learned Standing Counsel for the respondents.
The petitioner contends that he is owner and in possession over the house in question which the respondents are demolishing for the purposes of road widening, without his consent or paying any compensation for the same.
The controversy involved in this writ petition is similar to the controversy involved in Writ-C No. 7255 of 2018 – Manmohan Sachdeva and another v. State of U.P. and another. Writ-C No. 21540 of 2018 – Smt. Afroj Jahan v. State of U.P. and 4 others was also decided vide judgment and order dated 18.06.2018 in terms of the order in Writ-C No. 7255 of 2018.
In our view, the present dispute can also be decided in terms of the decision in the case of the order dated 17.04.2018 passed in Writ-C No. 7255 of 2018 – Manmohan Sachdeva and another v. State of U.P. and another.
In view of the above, the writ petition stands disposed of in same terms as in Manmohan Sachdeva and another (supra).
