Learned counsel for the revisionist states that the subsequent purchaser cannot be impleaded as a party during the pendency of the case.
In support of the contention he relied upon two decisions of the Apex Court in the case of Sanjay Verma Vs. Manik Roy and others, reported in (2006) 13 SCC-608 and Sunil Gupta Vs. Kiran Girhotra and others, reported in (2007) 8 SCC-506.
Till the next date of listing, the proceeding in Civil Appeal No. 55 of 2008 (Rizwan Khan Vs. Smt. Fahmida (deceased) and others pending before the Additional District Judge, Court No. 1, Muzaffarnagar shall remain stayed.
