Learned counsel for the applicants is permitted to make necessary correction in the application.
This application under Section 482 Cr.P.C. has been filed for quashing the Non-bailable warrant issued against the applicants by the Additional District Judge, Court No. 2, District Meerut in Criminal Appeal No. 55 of 2015 (Riyazuddin and others Vs. State of UP) arising out of Case Crime No. 547 of 2006, under Sections 323, 325, 504 and 506 IPC, Police Station Lisari Gate, District Meerut pending before the Additional District Judge, Court No. 2, District Meerut.
After having very carefully examined the submissions made by the learned counsel for the applicants and perused the material brought on record, I find that there is no justification for quashing the Non-bailable warrant issued against the applicants.
The prayer to that extent is hereby refused.
However, it is directed that in case the applicants surrender before the court below within 30 days from today and applies for bail, their prayer for bail shall be considered and decided by the Court below expeditiously in accordance with law.
For a period of 30 days from today or till the date of surrender, whichever is earlier, no coercive action shall be against the applicants.
However, in case, the applicants do not appear before the Court below within the aforesaid period, coercive action shall be taken against them.
It is made clear that the applicants will not be granted any further time by this Court for surrendering before the Court below as directed above.
With the aforesaid directions, this application is finally disposed of.
