Heard learned counsel for the applicants, learned A.G.A. for the State of U.P. in opposition and perused the record.
This application under Section 482 of the Code of Criminal Procedure (in short 'Code') has been filed on behalf of the applicants with a prayer to quash the entire proceedings of Criminal Case No. 1113 of 2018 (State vs. Riyaz Ahemad and others), arising out of Case Crime No. 384 of 2003, under Sections 498-A of IPC and Sections 3 and 4 of Dowry Prohibition Act Police Station - Hafizganj, District - Bareilly pending in the Court of A.C.J.M.-VI, Bareilly on the ground that the parties have settled their dispute.
Learned counsel for the applicants submitted certified copy of compromise. The trial court has rejected the compromise, on the ground that offence punishable under Section 498-A is not compoundable.
This is a case of matrimonial dispute, which has been amicably settled between the parties through mediation.
As per judgment of Hon'ble Apex Court in the case of Social Action Forum for Manav Adhikar and another Vs. Union of India reported in 2018 SCC OnLine SC 1501, the entire proceedings is quashed.
Accordingly, the instant application stands allowed.
