Heard Sri Shahabuddin, learned counsel for the applicant, Sri A.P. Singh, learned counsel for the opposite parties no. 1 to 5 and Sri Vidya Dhar Dubey, learned counsel for opposite party no. 6.
The instant contempt petition has been filed against the interim order, whereby, order of the Deputy Director of Consolidation and Settlement Officer, Consolidation was stayed.
On hearing the learned counsel for the parties at length, it is evident that serious disputed questions of facts are involved which cannot be gone into in contempt jurisdiction. It is not being disputed by learned counsel for the applicant that the counter affidavit along with stay vacation application is pending consideration before the writ court.
In view thereof, the appropriate course open to the applicant is to get the writ petition decided finally on merit.
The contempt petition is, accordingly, consigned to record.
