Heard learned counsel for the petitioner and Sri Neeraj Dube, learned counsel appearing for the National Highways Authority of India on merit.
The case of the petitioner is that since 2015, the arbitration proceedings as per the provisions of Section 3-G(5) of the National Highways Act, 1956 are pending before the Arbitrator. A direction is sought for expeditious disposal of the arbitral proceedings.
Having considered all facts of the case, we deem it appropriate to dispose of this petition for writ by directing the Arbitrator (District Magistrate,Bareilly) to decide the arbitration proceedings being Arbitration Case No. 45 of 2015 subject to just objections by either of the parties, expeditiously and as far as possible within a period of three months from today.
