JUDGMENT / ORDER

Petitioners herein are the two accused in Crime No.795/2013 of the Kanjaar Police Station, registered under sections 454 and 380 IPC, on the complaint of one Asharaf, that the petitioners committed theft of some machineries from the property belonging to his wife Raseena.
2. Asharaf and his wife Raseena are the respondents 2 and 3 herein. The petitioners seek order quashing the proceedings on the ground that they and the respondents 2 and 3 have come to terms amicably out of court. Respondents 2 and 3 have filed affidavit that the whole dispute now stands settled, and they have no grievance or complaint.

3. I am well satisfied that the alleged incident, in fact, happened in connection with some civil dispute and a crime happened to be registered under section 380 IPC. Anyway, the parties have come to terms amicably, and the whole dispute stands resolved. In such a situation, continuance of further proceedings in the crime will cause harm and hardship to both the parties. It will also not serve any purpose, other than wasting the precious time of the court.
In the result the petition is allowed. The F.I.R. and other proceeding is Crime No.795/2013 of Kanjaar Police Station will stand quashed under section 482 Cr.P.C.
