The petitioner has prayed for the following reliefs:
"Issue a writ order or direction in the nature of Mandamus directing the respondent no.-2 Sub Divisional Magistrate Kasya, District Kushinagar to decide the restoration application dated 19.05.2017, filed under Section 201 of U.P.L.R. Act, in case no. 205 of 2017, T201705446504937/Restoration (Riyajuddin & Others Vs. Gaon Sabha & others), under section 41 of U.P. Land Revenue Act 1901, as possible as early within a stipulated period."
Interest of justice will be served by directing the court below to decide the restoration application in accordance with law after hearing all necessary parties including the petitioners as well as the respondent nos. 4 to 16 preferably within a period of four months from from the date of receipt of a computer generated copy of this order, downloaded from the website of High Court, Allahabad. The authority/official shall verify the authenticity of such computerized copy of the order from the official website of High Court, Allahabad and shall make a declaration of such verification in writing.
It is clarified that this order is being passed when the threat of Covid-19 pandemic still exists. In case the court proceedings are held up due to Covid-19 outbreak, the lost working days shall be adjusted and the stipulated period of four months shall accordingly be enhanced.
With the aforesaid direction, the petition is finally disposed of.
