Heard learned counsel for the applicants, learned A.G.A. for the State and perused the record.
Present application has been filed against the order dated 7.1.2019 passed by the Additional Sessions Judge, Court No.8, Meerut in S.T. No.130 of 2015, State Vs. Riyajuddin and another, under Sections 147, 148, 149, 452, 307, 395, 323, 504. 506, IPC, P.S. Lisarigate, District Meerut by which the applicants' application dated 24.12.2018 with the prayer that compliance of Section 207, Cr.P.C. has not been made, has been rejected.
Learned counsel for the applicants has submitted that till date in compliance of Section 207, Cr.P.C. necessary paper has not been handed over to the applicants and the trial is proceeding.
Per contra learned A.G.A. has submitted that from the perusal of the order sheet dated 8.12.2014 it is evident that the applicants were handed over the necessary papers on which the prosecution wanted to place reliance on 8.2.2014 itself and therefore, the application filed by the applicant is frivolous and appears to have been filed just with an intention to linger on the trial. The trial court has passed the impugned order dated 7.1.2019 rejecting the said application, which is just, proper and legal and do not call for any interference by this Court.
The present application under Section 482, Cr.P.C. is wholly misconceived and is, accordingly, dismissed.
