Heard learned counsel for the applicants as well as learned AGA appearing for the State.
Present application has been filed for quashing the entire proceedings of Case No. 1761 of 2010 (Nazia Vs. Riyajuddin and others) in the light of compromise dated 04.02.2019, which was filed jointly by the applicant-1 and opposite party no.2.
Contention of learned counsel for the applicants is that compromise between the parties has already been taken place.
Under these circumstances, Judicial Magistrate-IInd, Ballia is directed to decide the Case No. 1761 of 2010 (Nazia Vs. Riyajuddin and others) on its own merit and pass appropriate order on the compromise application, jointly filed by applicant- 1 and complainant-opposite party no.2, in accordance with law, expeditiously, within a period of two months, provided there is no legal impediment and no unnecessary and long adjournments shall be granted to the parties.
With the aforesaid observations/ directions, the present application is finally disposed of.
