The petitioner has approached the Tahsildar, Talasseri for the issuance of dependency certificate. The petitioner is the daughter of Sri.Premachandran Kottayi, who died on 12.6.2012, while working as Agriculture Field Officer. The application of the petitioner was rejected stating that petitioner was married and her husband was in Military service at the time of the death of her father. Therfore, the petitioner is not a dependent. This Court in Ext.P9 states that mere employment will not make a person out of dependency. If any income ceiling has been fixed, that can only be the criteria for a person not to treat him as dependent. The petitioner relies on Ext.P8 Government order, wherein ceiling limit for getting the benefit dependency is fixed as Rupees 4.5 lakhs. In view of the above, an enquiry has to be conducted by the Tahsildar, whether the petitioner can be treated as dependent based W.P.(C).No.28874 of 2014

on Ext.P8 Government Order. Needful shall be done within a period of six weeks from the date of receipt of a copy of this judgment.
The writ petition is disposed of as above.
