Pursuant to the earlier order of the Court dated 18.07.2019, corpus-Ms. Riya@Awantika is present in the Court. She is carried by Mr. Deepak Sharma, S.I., Police Station-Shivrajpur, District-Kanpur Nagar, Ms. Neha, Lady Constable, Ms. Sonam Yadav, Lady Constable, Mr. Chandan Prasad, Constable, Police Station-Reserve Police Line, Kanpur Nagar. The corpus- Riya@Awantika is brought before the Court from Nari Niketan, Swaroop Nagar, Kanpur Nagar and is duly identified by learned A.G.A.
Today, the lawyers are observing strike, but since the corpus- Ms. Riya@Awantika was brought before the Court by the police personnels, for the sake of convenience of the corpus, the Court is taking this case ignoring the strike by the lawyers. None of the counsel has put in appearance on behalf of the parties.
The Court has got an opportunity to have conversation with the corpus-Ms. Riya@Awantika. She submits that she has passed her intermediate examination and as per High School Certificate, her date of birth is 01.01.2000. On making further inquiry, she submits that she has got married with Rohit Kumar@Sanjay on her volition and accord and now she intends to reside with her husband-Rohit Kumar@Sanjay. She next submits that she is on family way.
Taking into account her wish, desire and decision that she wants to go with her husband, she is set at liberty.
The habeas corpus petition stands disposed of with the aforementioned directions.
It is further directed that the amount of Rs.40,000/- so deposited by the husband-Rohit Kumar@Sanjay shall be released in favour of Ms. Riya@Awantika within fifteen days.
