Heard learned counsel for the applicant.
This application has been filed by the wife of opposite party for transferring Case No. 1506 of 2014 (Abhishek Khare Vs. Ritu Khare), under Section 9 of the Hindu Marriage Act, pending in the court of Additional Judge, Family Court No. 3, Kanpur Nagar to Lucknow on the ground that they were married in Lucknow and some cases filed by the applicant is pending in Lucknow.
Office report of 28.11.2019 reveals that the notice issued by registered post to the sole respondent fixing 31.10.2019 has been delivered.
Neither any counter affidavit nor any appearance has been filed on behalf of the opposite party.
The grounds mentioned in the affidavit filed in support of the transfer application appears to be correct.
Accordingly, this application is allowed and the aforesaid Case No. 1506 of 2014 is transferred from Kanpur Nagar to Lucknow.
