The FIR of this incident was lodged by the SHO, police station Hussainganj on 9.8.2019, alleging therein that five motorcycles were recovered from the possession of present accused and the other co-accused and on their pointing out four other motorcycles were also recovered on 9.8.2019.
The contention of the learned counsel for the applicant is that he has been falsely implicated in the present case due to ulterior motive. The recovery which has been shown from the applicant's possession is totally fake and false. There is no public witness of the alleged recovery. He further submitted that the co-accused Amit Maurya having similar role, has already been enlarged on bail vide order dated 25.9.2019 passed by this Court in Criminal Misc. Lastly, he submitted that the applicant has no criminal history and he is languishing in jail since 9.8.2019 and in case, he is released on bail, he will not misuse the liberty of bail and will cooperate in the trial.
Learned AGA has opposed the bail plea.
Considering the overall facts and circumstances, the nature of allegations, the gravity of offence, the severity of the punishment, the evidence appearing against the accused but without expressing any opinion on merits, this Court finds it to be a fit case for bail.
