Counter affidavit filed today, is taken on record.
The stand of the Principal, Sri Shiv Vijay Raghav Tulasi Das Inter College, Jharaa Kuti, Deoria, is that he received a certificate from the Board which was issued in favour of the petitioner. He did not correct any marksheet nor effected any change in the certificate. Certificate was received by him from the Board with a covering letter, which was handed over to the petitioner. He had no role either to correct the certificate or marksheet.
Learned counsel for the petitioner has produced the original copy of marksheet signed by the Principal of the Institution and original copy of the certificate issued by the Secretary of the Board showing that the petitioner had qualified the examination. This certificate is directly in conflict with the record of the Board which shows that the petitioner has not qualified the examination.
Let a notice be issued to Sri Achla Khnna, Secretary of the Board, to appear before this Court on 2.2.2012. She shall also file file an affidavit to indicate that on what basis this certificate has been issued.
Original copy of marksheet and certificate produced by the learned counsel for the petitioner are taken on record and shall be kept in a sealed cover.
Learned Standing Counsel is directed to inform Achla Khanna, Secretary Board in this behalf.
Let a copy of this order be given to Sri Moti Lal, learned Standing Counsel for compliance of the order free of cost within 48 hours.
