Heard learned counsel for the parties.
The applicant is before this Court for a direction to initiate contempt proceeding against the opposite parties for wilful disobedience of the judgement and order dated 29.01.2009 passed in Writ Petition No.3891 of 2009.
In the aforesaid order, by calling counter affidavit a direction was given to the opposite party that until further orders of this Court, dispossession of the petitioner from the chak in his possession in pursuance to the order impugned in the writ petition, shall remain stayed. More than 12 years have lapsed, from the date the aforesaid order has been passed.
In the facts and circumstances of the case, this Court is of the opinion that the applicant will contest his matter before the Writ Court itself. In case, the applicant files an application for urgent listing of the case before the Writ Court, the same shall be considered and decided expeditiously in accordance with law.
With the aforesaid directions, the present contempt application is disposed of.
