Pursuant to an order passed by this Court on 18th April, 2015 in Writ Petition No.782 of 2007, claim of the petitioner against a short term vacancy has been considered, and direction has been issued to release salary. It is stated that salary is being paid to petitioner ever since then. It is contended that petitioner's claim for regularization is covered under Section 33(g) of the U.P. Secondary Education Service Selection Board Act, 1982, and the proposal has been forwarded to the District Inspector of Schools, Bhadohi, whereafter the claim has remained pending and no decision has been taken.
Learned Standing Counsel submits that claim of the petitioner shall be examined, in accordance with law.
Considering the facts and circumstances, brought on record, this writ petition stands disposed of with a direction upon the 4th respondent to forward the claim of petitioner to the 3rd respondent, within a period of six weeks from the date of presentation of certified copy of this order. The 3rd respondent shall get the matter investigated, in accordance with law, and an appropriate decision would be taken, within a further period of three months, thereafter.
It is made clear that petitioner's claim has not been examined by this Court on merits and all questions are left open to be considered by the Competent Authority, in accordance with law.
