Heard learned counsel for the applicant and the learned A.G.A.
It is argued that the case of the applicant is on similar footing as Raj Kumar alias Raju, who has been granted bail by an earlier order of this Court dated 11.9.2009 on the ground that only joint recovery of a motorcycle has been seen of the applicant with Raj Kumar alias Raju which as argued was a plant by the police. Learned AGA could not point out any distinction in the case of the applicant from the co-accused Raj Kumar alias Raju, but he opposed the prayer for bail.
Having considered the submissions of the parties and without expressing any opinion on the merits of the case, let the applicant Rishi alias Pintu involved in case crime No. 517 of 2008, under Section 302, 364, 201 I.P.C., Police Station Govind Nagar, district Mathura be released on bail on his executing a personal bond and furnishing two sureties each in the like amount to the satisfaction of court concerned.
