Petitioner obtained passport bearing registration No.F5343320. This was issued in the year 2005. In the above passport, date of birth of the petitioner is shown as 17.07.1980. According to the petitioner, his actual date of birth is 17.02.1985. Petitioner has approached the passport authorities for correction. They refused to entertain petitioner's application.
2. A statement has been filed in this matter by the passport authorities. It is stated that petitioner obtained passport by producing birth certificate and birth certificate clearly shows that date of birth is as shown in the passport. In view of the above, the application cannot be accepted.
3. Learned counsel for the petitioner submits that his date of birth has been corrected by the Registrar of Births and Deaths and therefore he is entitled to correct the passport in accordance with the changes effected in the date of birth.
4. I am of the view, if the petitioner's date of birth is corrected in the birth certificate, necessarily the corresponding changes also have to be made in the passport. However, genuineness of the claim has to be examined by the passport W.P(C).No.18058 of 2014 2 authorities. If the passport authorities feels that petitioner's date of birth has been corrected by competent authority, necessary changes have to be effected. On being satisfied with the genuineness of such claim, passport authorities shall correct the passport in accordance with law within a period of four weeks from the date of receipt of a copy of this judgment.
The Writ Petition is disposed of.
