Heard learned counsel for the applicant and learned A.G.A. for the State.
This application under Section 482 Cr.P.C. has been filed for quashing the further proceeding if Special Sessions Trial No. 262 of 2018(State Vs. Rishabh Tiwari alias Aditya Tiwari) as well as charge sheet dated 29.3.2018 under sections 452, 323, 504, 354 I.P.C. and section 3(2) V-a of S.C./S.T. Act P.s. Chakeri District Kanpur nagar pending in the court of Special Judge(S.C./S.T. Act) Kanpur Nagar.
Learned counsel for the applicant submits that he has been falsely implicated by the police under the alleged sections.
In that view of the matter, he is permitted to move discharge application before the trial Court within three weeks from today and the trial court shall decide the same within a period of one month from the date of filing of the application alongwith certified copy of this order.
Till the discharge application is decided, no coercive measures shall be taken against the applicant.
With the aforesaid directions, this application is finally disposed of.
