JUDGMENT / ORDER

By way of these petitions, the petitioners have challenged the order dated 31.12.2011 where under the Talati-Cum-Mantri passed orders declining the prayers made in the application for change in the birth certificate.
Prima facie it appeared that it was contrary to the provision of Section 15 of the Registration of Births and Deaths Act, 1969, hence, the learned AGP was requested to take appropriate instructions so that the Court may pass appropriate order. Accordingly Shri Soni, learned AGP inquired and received instruction from A.D.Solanki, Probationary Talati-Cum-Mantri, Pipan and submitted that this impugned order would be withdrawn and fresh order would be passed after affording an opportunity to the petitioners. Petitioners will be at liberty to approach the office of respondent no.2 with appropriate documentary evidences.
Learned advocate for the petitioners submitted that the petitioners would approach the office of the respondent no.2 on 02.04.2012 with documents in support of the application and the respondent no.2 may pass order thereon.
In view of this, Shri Vyas seeks permission to withdraw these petitions, at this stage, with a liberty to file fresh petition, in case of difficulty.
Permission, as sought for is granted the petitions are disposed of as withdrawn. No cost. Direct service is permitted.
Office to keep copy of this order in each matter.
