Heard Sri Sanjeev Kumar Pandey, learned counsel for the petitioners, the learned AGA and perused the impugned F.I.R, as well as material brought on record.
The relief sought in this petition is for quashing of the F.I.R. dated 5.1.2019 registered as Case Crime No. 22 of 2019, under sections 60, 63, 72 U.P. Excise Act, P.S. Dadri District Gautam Budh Nagar.
Matter relates to production of illicit liquor and the contention of the learned counsel for the petitioner that he was not arrested on the spot and in fact his name surfaced in the confessional statement of co-accused Pankaj, cannot be a good ground to quash the F.I.R. From the perusal of the FIR, prima facie, cognizable offence is made out. Hence, no ground exists for quashing of the F.I.R.
