Heard learned counsel for the petitioner and learned Standing Counsel for the State- respondents.
The writ petition has been filed seeking a writ of certiorari for quashing the order dated 29.6.2013 passed in revision under Section 229-B of the UP Land Revenue Act by the Additional Commissioner, Meerut Division Meerut.
This revision arose out of proceedings under Section 33/39 for correction of papers.
A supplementary affidavit has been filed to explain the delay of 2237 days which has been stated that the grand father of the petitioner was contesting the case and petitioner was aware of the case and, therefore, the delay.
Be that as it may, the fact remains that the orders passed in summary proceedings under Section 33/39 of the UP Land Revenue Act are subject to final orders to be passed in title proceedings in view of Section 40-A of the UP Land Revenue Act. Their findings are not binding in regular proceeding.
Under the circumstances, this Court does not consider it expedient to interfere.
The petitioner, in case, so advised, may file a suit seeking a declaration in his favour.
Subject to the above, this writ petition stands disposed of.
