Office report dated 25.03.2019 states that the notice of this transfer application has been delivered to the opposite party. The notice has been delivered on 12.03.2019.
Despite notice, neither any counter affidavit nor any appearance has been filed on behalf of the opposite party.
Transfer is sought also on the basis of the averments made in paragraph 6 of the affidavit, filed in support of the transfer application, although its transfer is being sought on the ground of convenience.
However, this Court, from the averments made in paragraphs 6 and 7 of the affidavit, is of the considered opinion that the proceedings under Section 128 Cr.P.C. of 2011 must necessarily have, either be disposed of or rendered infructuous.
Counsel for the applicant seeks time to file a supplementary affidavit in this regard.
