Heard Sri Swetashwa Agarwal, learned counsel for the petitioner, Sri Deepak Mishra, learned A.G.A. for the State and perused the impugned F.I.R. as well as material brought on record.
This petition has been filed by the petitioner with the prayer commanding and directing the respondents concerned to submit progress report of case crime no.218 of 2017, u/s 147, 148, 149, 323, 307, 504 IPC and 3(2) (V) SC/ST Act, P.S. Sehpau, district Hathras.
Learned counsel for the petitioner submits that the coordinate Bench of this Court had stayed the arrest of three accused persons in Criminal Misc. Writ Petition No.19463 of 2017 but another petition i.e. Criminal Misc. Writ Petition No.20244 of 2017 filed by the two accused persons was dismissed for want of prosecution by this Court on 20.4.2018. The petitioner is the injured person and the informant of the case who was the father of the petitioner has died but the investigation of the case has not been concluded till date.
Considering the facts and circumstances of the case and the submissions advanced by learned counsel for the petitioner, we direct the Investigating Officer of the present case to conclude the investigation and submit a police report before the court concerned expeditiously preferably within the period of three months from the date of production of a certified copy of this order.
The S.P, Hathras is directed to ensure the compliance of this order. With the aforesaid directions, the present petition stands disposed of.
