This petition has been filed by the petitioners for quashing the impugned F.I.R. registered in N.C.R. No.31/2010 under Section 498 I.P.C. and in Case Crime No.86 of 2010 under Section 498, 363, 366 I.P.C., Police Umari Begumganj, District Gonda.
This Court on 15.6.2010 had directed the petitioners to produce the girl, namely, Radha and Rinku Singh petitioner no.1 with whom allegations are that she had married and to appear before this Court.
Radha Singh was identified by Shri Dhar Shukla, who is said to be father of Radha Singh and she states that she had married Rinku Singh on her free will and she is residing with him.
Accordingly, we direct that Radha Singh is free to live with a person of her choice since she seems to be major. Arrest of the petitioners( Rinku Singh and Brijesh Singh ) in aforesaid case crime number, shall remain stayed. However, investigation shall continue and petitioners shall cooperate with the same.
With the aforesaid observations, the petition is finally disposed of.
