Order on Criminal Misc. bail Application No. 104973 of 2017 Counter affidavit has been filed by the State, let it be taken on the record.
Applicant seeks bail in ST No.347 of 2014 and 405 of 2014 State Vs. Rinku Singh and others arising out Case Crime No. 380 of 2014 under sections 302 and 504 I.P.C. and in Case Crime No. 381 of 2014 under section 3/25 Arms Act P.S. Sahatwar district Ballia.
Heard learned counsel for the applicant and learned AGA for the State.
Perusal of record shows that as per the evidence of P.Ws 2 and 3, the applicant is the main assailant and specific role in the FIR has been assigned to him. Two persons have been done to death. There is no ground for bail.
In view of the aforesaid facts and circumstances, we do not find it a fit case for bail. The application for bail is hereby rejected at this stage.
