JUDGMENT / ORDER

Heard learned counsel for the applicant, learned A.G.A. and perused the record.
It is submitted by learned counsel for the applicant that the aplicant is innocent and has been falsely implicated. It is stated that the general allegations of pelting stones at the Police party which had come to investigate some complaint in which one home guard is said to have been injured, have been made against the applicant. It is further stated that the incident took place at night and it was not possibler for the police party to identify anyone It is further submitted that the Smt. Chandrawati and Raghubeer Singh have already been granted bail in Case crime no.149 of 2009 by this Court on 27- 10-2009 and 11-11-2009 in Bail Application No.26152 of 2009. It is furrther submitted that the case of the applicant stands on the same footing and claimed parity. He is in jail since 1-9-2009 and has got no other criminal history.
In view of the facts and circumstances of the case and submissions made by learned counsel for the applicant and learned A.G.A. and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Rinku alias Kripal Singh involved in Case crime no.149 of 2009 under section 147, 332, 353, 307, 323, 504, 506 IPC Section 3(1) X of SC/ST Act and Section 7 Crl. Law Amendment Act Police Station Pachokhara district Firozabad be released on bail on his on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
