Heard learned counsel for the petitioner and Shri Anurag Srivastava, learned Standing Counsel for the State respondents.
The petitioner is before this Court with request to issue direction to the respondents to restore her possession over Arazi No.231 area 0.12 hectare situated in Village Gangkishor, Sikandarpur, District Ballia.
Learned counsel for the petitioner states that the allotment in question was made in favour of the petitioner in the year 2016 and Form 49-Cha was issued in her favour. Due to village rivalry, Bhagwan Rai and other persons have forcefully removed the possession of the petitioner over the allotted land. The petitioner has also lodged the first information report on 11.4.2017. She has also moved an application under Section 122D of U.P. ZA & LR Act/Section 65 of U.P. Revenue Code, 2006 on 23.5.2017 for restoring her possession over the land in question. The request has been made for issuing direction to the Sub Divisional Magistrate to decide the aforesaid application expeditiously.
Learned Standing Counsel fairly states that in case the aforesaid application is still pending and has not been disposed of, the same will be considered and decided expeditiously.
In view of the above, on consent and without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally with a direction to the third respondent to do needful and decide the aforesaid application, as expeditiously as possible and preferably within a period of four months from the date of production of a certified copy of this order before him.
