JUDGMENT / ORDER

Being aggrieved by Exhibit P1 assessment order dated 24.06.2014 passed by the 2nd respondent for the assessment year 2012-13, the petitioner has approached the 1st respondent by filing Exhibit P2 appeal along with Exhibit P3 petition for stay. The petitioner is apprehending coercive proceedings in the meanwhile and hence this writ petition. 2. Heard the learned Counsel for the petitioner as well as the learned Government Pleader appearing for the respondents.
3. The learned Counsel for the petitioner points out that the assessment was finalized as per Exhibit P1, mainly for want of necessary ‘C forms’. It is stated that there occurred some delay in collecting all the ‘C forms’ and the petitioner is now having all the ‘C forms’ which are being produced before the Appellate Authority. Copies of the ‘C forms’ have been produced along with the writ petition as Exhibits P5 to P18.
4. Considering the facts and circumstances, the 1st respondent is directed to consider and pass a speaking order on Ext.P3 petition for stay, in accordance with law, as expeditiously W.P.(C). No. 26413 of 2014 2 as possible, at any rate, within 'one month' from the date of receipt of a copy of this judgment. Coercive proceedings pursuant to Exts.P4 shall be kept in abeyance till such time.
The petitioner shall produce a copy of this judgment along with a copy of this writ petition before the concerned respondent for further steps. The writ petition is disposed of as above.
