Sri Sunil Kumar Tripathi, learned counsel for the petitioner prays for withdrawal of the writ petition with liberty to move an appropriate application before the Labour Court, U.P. Varanasi seeking recall of the award dated 26.09.2018 passed in Adjudication Case No. 23 of 2013 which is said to have been passed ex-parte against the petitioner.
Sri Praveen Kumar Singh, learned counsel appearing for the contesting respondent no.4-workman has no objection to the prayer so made.
The writ petition is dismissed as withdrawn with liberty aforesaid.
