Heard learned counsel for the applicant.
This petition has been preferred alleging disobedience of an order dated 21 September 2017 which had commanded the District Magistrate, Bhadohi to decide an application moved by the applicant seeking recall of the order dated 30 December 2013. The Court had further observed that the District Magistrate would move in the matter with expedition and endeavour to decide the same preferably within a period of three months. From a perusal of the order dated 30 December 2013, the Court notes that the same has been passed pursuant to directions issued in another writ petition being W.P. No. 52762 of 2013. The order further discloses the pendency of yet another writ petition being Writ-B No. 29925 of 2002.
From the Supplementary Affidavit filed today, it appears that the latter writ petition was dismissed in default on 27 October 2017. However, learned counsel for the applicant admits that an application for restoration has since been moved.
On an overall conspectus of the aforesaid facts, this Court finds no ground to hold the opposite party in wilful or deliberate disobedience.
The petition is consequently dismissed.
