It is stated that husband of petitioner no.1 and father of petitioner no.2, late Izhar Ahmad Khan, was the sole bread earner of the family and was working as Assistant Teacher in Primary School at Village Dhaurra, Block Khandari, District Agra, who has died in harness on 17.4.2011. Claim for grant of compassionate appointment has been made, which is stated to have remained pending for unusually long. This petition has been filed for a direction upon the authority concerned to examine the claim of petitioner, in accordance with law.
Considering the facts and circumstances, noticed above, this writ petition is disposed of permitting the petitioner to approach respondent no.3, alongwith certified copy of this order, within a period of one month from today. In case such a claim is raised, the same shall be examined, in accordance with law, by the authority concerned, within a further period of four months, thereafter.
It is made clear that this Court has not adjudicated the claim of petitioner on merits, and all issues are left open to be considered by the authority concerned, at the first instance.
